How do I know it is the sender and not the gauge?

With the key on, a needle that sits pinned on empty or full and never moves usually means a worn sender track or a stuck float. Clean the tank connector first - if the reading still misbehaves, the sender is the fix.

Do I need to drain the tank to fit it?

No full drain needed - just run the tank low first, since the sender mounts through the tank flange and less fuel makes the swap cleaner. Disconnect the battery before unplugging the sender connector.
